Cookie policy
The Authority for the Protection of Personal Data issued last May 8, 2014 order no. 229, entitled "Identification of simplified procedures for the information and the acquisition of consent for the use of cookies", with subsequent publication in the Official Gazette on June 3, 2014. Through this provision, the Guarantor incorporates the European directives under which every web site must show an information banner that informs, at first login of a visitor, of the cookie policy implemented by the site that they are visiting. What are cookies?
Cookies are strings of small size text sent by a server to a Web client (usually a browser) and then sent back by the client to the server (without change) each time the client logs on to the same portion of the same web domain. While navigating on a site, the user may receive on his terminal even cookies that are sent from different web sites or servers (so-called "third party"), on which they may reside some elements (such as, for example, images, maps, sounds, specific links to pages from other domains) on the same site which is being visited.
Cookies are typically found in the users’ browsers in large numbers and sometimes in temporal persistence characteristics. These are used for different purposes: running computer authentication, tracking sessions, storing information about specific configurations regarding the users who access servers, etc.
The Guarantor, in order to reach a proper regulation of the directive, identified two broad categories of cookies: Technical cookies and profiling cookies; the Guarantor has also defined a further differentiation regarding the subject that installs cookies, which can be the same as the site manager ("publisher") or a third party, which installs cookies through the first subject, defining these as third party cookies. In the latter case, the Guarantor has expressly limited the responsibility of the publisher stating that the party installing cookies shall refer to the regulation.
Technical cookies
Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication over an electronic communications network, or as strictly necessary for the media service provider explicitly requested by the subscriber or user to provide this service "(cfr. art. 122, paragraph 1, of the Code).
They are not used for other purposes and are normally installed by the owner or operator of the website. They can be divided into navigation or session cookies, which guarantee the normal navigation and use of the website (allowing, for example, a purchase or an authentication to access restricted areas); analytics cookies, which are similar to the technical ones when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site; feature cookies, which allow the user navigating according to a set of selected criteria (eg, language, products selected for purchase) in order to improve the renderd service.
For the installation of these cookies prior consent of users is not require. However, obligation to provide the information pursuant to art. 13 of the Code still in force.
Profiling Cookies
Profiling cookies are designed to create profiles of the users and are used in order to send advertising messages in line with the preferences expressed by the same part during web browsing. Given the considerable invasiveness that such devices may have within the private sphere of the users, the European and Italian legislation requires the user to be properly informed on the use of the same and express their valid consent.
For these we shall refer to the art. 122 of the Code where it provides that "the storage of information in the terminal equipment of a contractor or a user or the access to information already stored are only allowed on condition that the contractor or the user has given his consent after being informed through simplified procedures as per the Article 13, paragraph 3 "(art. 122, paragraph 1, of the Code).
